Nigeria's Supreme Court, has overruled the order given to the federal government by the Appeal Court to release the leader of the Indigenous People of Biafra, IPOB, Mazi Nnamdi Kanu. 

In a five-man unanimous judgement read by Justice Emmanuel Agim on Friday, the apex court also okayed the authority of the trial court to continue with his trial. 

According to the court, though the federal government acted irresponsibly in the manner it forcefully brought him from Kenya against all known law, the infraction was not enough to divest the trial court of its jurisdiction to continue with the case. 

It noted that there is no law in the country that removed the authority of the trial court to try his case despite federal government's illegal action against him.

The court added however, that Kanu has the option of institution a civil action against the federal government over the illegal action. 

The IPOB leader has been in detention since June 29, 2021.
