N805m Fraud: Supreme Court Nulifies Sen Nwaoboshi's Conviction
*Orders his immediate release.
Nigeria’s apex court, the Supreme Court, on Friday, nulified the conviction of the Senator representing Delta North, Peter Nwaoboshi, over fraud and money laundering.
The court also vacated his his seven year prison sentence over same and ordered his immediate release from the Ikoyi prisons, Lagos, where he is being held.
The court further set free Sen Nwaoboshi’s two companies, Golden Touch Construction Project Ltd and Suiming Electrical Ltd, tried along with him by the Economic and Financial Crimes Commission, EFCC, on a two-count charge.
In a four-to-one split decision, the Supreme Court dismissed the the judgment of the Court of Appeal, Lagos, delivered on July 1, 2022, which reversed an earlier discharge and acquittal decision by a Federal High Court, Lagos.
Justice Emmanuel Agbim, who delivered the lead judgment, held that Sen Nwaobishi and the two companies were unjustly and maliciously prosecuted by the EFCC for committing offenses not known to law, adding that they were subjected to needless criminal trial in relation civil transaction.
